ABSTRACT Firstly, the paper introduces the historical and contemporary nature and practices involved with the institution of adoption and it's effects. The implications regarding the welfare of the child are examined. The best interest of the child principle is explored by discussing the psychological effects involved when adoption takes place in a same sex couple situation. Princípio constitucional do melhor interesse da criança 2. Realidade social e o melhor interesse da criança. Muitos desses superados em diversas culturas, mas infelizmente mantidos em outras. O princípio do interesse do menor obteve tamanha preeminência na seara do Direito de Família que passou a ser o elemento norteador dos ordenamentos, nesse âmbito. Nas palavras do doutrinador Guilherme Calmon Nogueira da Gama, o princípio do melhor interesse da criança: representa importante mudança de eixo nas relações paterno-materno-filiais em que o filho deixa de ser considerado objeto para ser alçado — com absoluta justiça, ainda que tardiamente — a sujeito de direito, ou seja, à pessoa merecedora de tutela do ordenamento jurídico, mas com absoluta prioridade comparativamente aos demais integrantes da família que ele participa.

Homosexuals prefer to adopt children who are not in the most requested profiles, such as afro-descendants, disabled people etc. Prejudice is a reality for the children of homosexuals, but adoption is still much more beneficial than leaving them in institutions, where they do not have the necessary care, affection and attention. Children of homosexual couples have the same social competence and psychological and mental health than the children of heterosexuals.
